1. Agreement to Terms - By downloading or using the Flashcards mobile application (the "App"), operated by HaggisTofu ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service - Flashcards is a tool designed to help users create, manage, and study digital flashcards. The App includes features such as local data storage, import/export capabilities, and speech-to-text functionality.

3. User Content and Data - You are solely responsible for the content of the flashcards you create. All data is stored locally on your device. We do not have access to, nor do we back up, your flashcard data. It is your responsibility to use the "Export" feature if you wish to maintain backups.

4. Acceptable Use - You agree not to use the App for any illegal or unauthorized purpose. You must not, in the use of the App, violate any laws in your jurisdiction.

5. Intellectual Property - The App's original content (excluding user-generated flashcards), features, and functionality are and will remain the exclusive property of HaggisTofu. The App is protected by copyright and other laws.

6. Termination - We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Limitation of Liability - In no event shall HaggisTofu be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

8. Disclaimer - Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind.

9. Changes to Terms - We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Last updated" date at the top of these Terms.
